COVID-19 fixed penalty fines

1. Overview

Under the Coronavirus Act (2000), there are regulations in place for the protection of health to support the reopening of businesses. Please see the latest Government guidance on making workplaces COVID secure.

You may receive a fixed penalty notice for one of the following breaches:

  • Opening a restricted business or service between the hours of 10pm to 5am.
  • Failing to implement restrictions on group sizes and service of food and drink consumed on the premises.
  • Not displaying the QR Code for use with the NHS COVID-19 app. For information on how to create a coronavirus QR code for your venue see the Government website.
  • Failure to display a notice advising of the legal obligation to wear a face covering
  • Failure to record customer details for Track & Trace plus keep records for 21 days.
  • Failure to ensure the premises complies with the COVID secure requirements.

The penalties are set at:

  • £1,000 (for 1st Penalty Notice)
  • £2,000 (for the 2nd Penalty Notice)
  • £4,000 (for 3rd Penalty Notice), and
  • £10,000 for the 4th and any further Fixed Penalty Notices served thereafter).

The penalty must be paid within 28 days.

If you pay the penalty, you cannot be convicted for the offence to which the Fixed Penalty Notice (FPN) relates and no further action will be taken against you.

If the FPN is not paid, you will be prosecuted and if convicted subjected to a fine imposed by the courts.
