Overview

Under schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982 anyone selling, exposing or offering for sale anything (including a living thing) in a ‘consent street’ within Gravesham needs a street trading consent.

A consent street is: All roads, pavements, verges, laybys or similar pieces of land forming part of the public highway, unless there is a payment for entry.

In the above locations, it is illegal to carry out street trading without a consent.

Before submitting an application, please read through the below guidance and the Street Trading Policy so you are familiar with what is required.

Types of consent

You will need to consider what type of consent you need. Please read the policy for a more detailed explanation of these types of consent.

  • Static – You trade from the same location at all times
  • Mobile – You move around the borough, stopping at different locations i.e. ice cream van
  • Multiuser – You are holding an event with multiple traders over a maximum of four days

How long does a consent last?

Static and mobile consents are issued for a 12 month period.

A Multiuser street trading consent covers a maximum of four consecutive days.

How much does it cost?

New and renewal applications

New or renewal applications for a street trading consent are payable in two instalments.

Part A is the application and consultation fee, which is non-refundable should your application be refused.

Part B is the grant fee - you will only need to make this payment if your consent is going to be issued.

Amendments

If you need to make amendments to the consent during its lifetime, you will need to submit one of the following applications with the associated fee.

Food hygiene registration

If you are going to be selling food, you must be registered as a food business with the council in whose area the trading unit is stored when not trading.  If you are pre-preparing food, you need to be registered with the council in whose area you prepare the food.

Planning permission

If you want to trade on the same piece of land for more than 28 days in the year, whether it is public or private land, you will need to seek planning permission.

Sale of alcohol or late night refreshment

If you are going to be:

  • Selling alcohol at any time, or
  • Selling hot food or drink between 11pm and 5am

You will need to obtain the appropriate licence under the Licensing Act 2003.

Tables and chairs

If you wish to place tables and chairs alongside your unit, for your customers to consume food or drink supplied by you, you may require a Pavement Licence.

Advertising

If you wish to place advertising through the borough or an A-board at the location of the trading unit, you will need to contact Kent County Council Highways to obtain the appropriate permission.

Waste removal

It is your responsibility to ensure that your waste is disposed of appropriately.

Permission from private landowner

If the land you wish to trade on it privately owned, you must have permission from the landowner to be able to trade on their land.  You will have to provide evidence of the granted permission.
